Il giudice investito dell'opposizione a decreto ingiuntivo, ove accerti l'incompetenza del proprio ufficio ad emettere il provvedimento monitorio, deve dichiararne la nullità, con ciò esaurendo la propria Competenza funzionale in ordine al giudizio di opposizione.
