La responsabilità del compartecipe ex art. 116 cod. pen. è da escludere soltanto nel caso in cui l'evento del reato diverso e più grave commesso dall'altro concorrente abbia carattere atipico e si verifichi per circostanze eccezionali e del tutto imprevedibili.
