La violazione dell'Obbligo imposto all'imprenditore di mantenere gli impianti, le macchine e le attrezzature in buono stato di conservazione e di efficienza costituisce un comportamento colposo, che e fattore causale di tutti i possibili eventi dannosi provocati dalla difettosita dell'utensile.
