La consegna di un autoveicolo riparato al posto di quello nuovo di fabbrica, pattuito nel relativo contratto di compravendita, non integra l'ipotesi della consegna di aliud pro alio bensi quella della Mancanza di qualita, disciplinata dall'art 1497 cod civ. (Conf 3818/76, mass n 382504).*
