L'accertamento che un determinato bene non e compreso tra quelli che hanno formato oggetto di un contratto di divisione, riferendosi ad un rapporto plurisoggettivo concettualmente unico ed inscindibile, non puo che essere compiuto nei confronti di tutti i condividenti. (V 2380'66, mass n 324615).*
