Il criterio distintivo tra l'Esercizio arbitrario delle proprie ragioni e l'estorsione sta nell'elemento intenzionale, richiedendosi nel primo che il soggetto agisca al fine di esercitare un diritto, anche se non sussistente, con la consapevolezza in buona fede di poterlo legittimamente realizzare, nel secondo che il soggetto miri a conseguire un profitto obiettivamente e subiettivamente ingiusto.
