Nel procedimento ingiunzionale la sentenza che rigetta integralmente l'opposizione non si sostituisce al decreto ingiuntivo impugnato: in tal caso, pertanto, il titolo esecutivo e costituito dal decreto e non gia dalla sentenza che lo conferma. (Conf 4082/68, mass n 337734).*
