In tema di incidente stradale, il dubbio sul verificarsi di un malore improvviso del conducente, risolvendosi in un dubbio sulla sussistenza di un elemento che attiene all'imputabilità e cioè alla capacità d'intendere e di volere al momento del fatto, consente al giudice di pronunciare legittimamente una sentenza di assoluzione con formula dubitativa.
