Nel procedimento di urgenza ex art 700 cod proc civ, caratterizzato dal fatto che il ricorso investe senz'altro il giudice adito della potesta di decidere nel merito anche inaudita altera parte, la prevenzione e determinata dal deposito del ricorso e non gia dalla notificazione del medesimo.
