Ai sensi dell'art. 2697 cod. civ., colui che domanda la risoluzione del contratto per inadempimento dell'altra parte è tenuto a provare, con ogni circostanza inerente, il fatto costituente l'assunto inadempimento, che legittimi la chiesta risoluzione.
