La proroga del termine per l'adempimento pur non essendo incompatibile in modo assoluto con il suo carattere essenziale, fornisce un importante elemento presuntivo circa la sua natura meramente ordinatoria - secondo l'incensurabile apprezzamento del giudice del merito - in guisa da escludere che l'adempimento tardivo sia privo di interesse per il creditore.
