SERVITÙ - PREDIALI - COSTITUZIONE DEL DIRITTO - DELLE SERVITÙ VOLONTARIE - COSTITUZIONE NEGOZIALE - IN GENERE

Le servitù costituite negozialmente sono opponibili ai terzi acquirenti del fondo servente, non soltanto nell'ipotesi in cui il titolo della servitù sia stato trascritto, ma anche quando, mancando tale trascrizione, si faccia espressa menzione della servitù nell'atto di trasferimento al terzo del fondo servente.
