I termini perentori per impugnare rientrano nell'istituto generale della decadenza e, pertanto, decorrono per il solo fatto materiale del trascorrere del tempo, indipendentemente dalle situazioni soggettive ed oggettive verificatesi medio tempore e dalle quali sia dipeso l'inutile decorso del termine, salvo le eccezioni tassativamente previste dalla legge (artt. 328, primo comma, 395 n. 1, 2, 3 e 6 e 397, secondo comma, cod. proc. civ.).
