COMUNIONE DEI DIRITTI REALI - CONDOMINIO NEGLI EDIFICI - PARTI COMUNI DELL'EDIFICIO - SOTTOTETTI, SOFFITTI, SOLAI - SOTTOTETTO - PERTINENZA DELL'APPARTAMENTO ALL'ULTIMO PIANO - CONFIGURABILITA - CONDIZIONI.*

Il 'sottotettò di un edificio puo considerarsi pertinenza dell'appartamento sito all'ultimo piano solo quando assolva all'esclusiva funzione di isolare e proteggere l'appartamento medesimo, tramite la creazione di una 'camera d'arià, e non anche, pertanto, quando abbia dimensioni e caratteristiche strutturali tali da consentirne l'utilizzazione come vano autonomo (deposito, stenditoio, eccetera).
