NEGOZI GIURIDICI - DI ACCERTAMENTO - DI UN RAPPORTO REALE - EFFETTO TRASLATIVO - ESCLUSIONE - FONTE ORIGINARIA DEL RAPPORTO - PREVALENZA.*

Il negozio di accertamento di un rapporto reale non puo avere alcun effetto traslativo, onde per la regolamentazione della relativa situazione giuridica controversa, deve farsi capo, in ogni caso, alla fonte originaria, che ne costituisce il fondamento e che non e sostituibile dal negozio di accertamento.
